Why didn't Joe Grubbs prosecute convicted Catholic priest Rudy Kos?

Kos attended the same church that Judge Gene Knize attends. (St. John's in Ennis)

The victims were from Ellis County.

The crimes occurred in Ellis County.

Joe Grubbs was the prosecutor.

Why wasn't this prosecuted in Ellis County?
